Samantha Ruth Prabhu has won a vital court battle against online misuse of her identity. The Bombay High Court handed down a significant ruling on Thursday.

Ordering AI platforms, e-commerce sites, and digital media companies to obtain permission before using her name, likeness, and voice. The court also mandated the removal of any unauthorized content featuring the actress.

According to India Today, Samantha had moved the court to seek protection against the creation and circulation of AI-generated, morphed, and deepfake content built around her identity. Her suit targets unknown infringers as well as a range of technology platforms. This includes AI developers, digital media companies, and e-commerce entities, totaling 18 defendants.

Government bodies are also among the entities targeted by her lawsuit.

Justice Madhav Jamdar found that the material presented in court suggested a clear infringement of Samantha's personality and publicity rights through non-consensual AI-generated deepfakes and morphed content. The court's ruling highlighted the importance of protecting Samantha's rights under the Constitution of India.

Specifically the right to freedom of speech and expression, as well as the right to life, personal liberty, privacy, and human dignity. Furthermore, the court noted that Samantha's moral rights as a performer are separately protected under Section 38B of the Copyright Act.

On December 10, the court will reconvene to consider the matter further. Following its earlier ruling, the court has issued a directive requiring the removal of the disputed content and imposing a temporary restraining order, effectively halting any unauthorized use of the individual's name, likeness, and voice.
