Mushroom murderer Erin Patterson is appealing - here's what you need to know

A year after being sentenced to life in prison for murdering three relatives with a toxic mushroom meal, Erin Patterson is now seeking to overturn her conviction.

Patterson, 51, was found guilty of killing Don and Gail Patterson, both 70, and Heather Wilkinson, 66, who died within days of eating the mushrooms at her home in Leongatha, Victoria, in 2023.

Her lawyers claim that she did not receive a fair trial due to issues with evidence, prosecution actions, and an unusual mishap with the jury during deliberation.

Patterson's estranged husband, Simon Patterson, was also poisoned

Her lawyers argue that certain evidence, such as mobile phone tracking data and online messages from 'Facebook friends', should not have been allowed in court due to being prejudicial and irrelevant.

The prosecution, however, argues that Patterson's sentence is 'manifestly inadequate' and that she should never be freed.

A hearing to review her conviction is currently underway, with Patterson appearing via video link from a maximum security prison on the outskirts of Melbourne.

Her legal team has filed a three-page document outlining seven grounds for appeal, which will be heard in court soon.

Patterson's lawyers claim that other pieces of evidence could have helped her case, including photos and images related to her hobby.

The judge initially stated that Patterson could apply for parole after 33 years, but the prosecution disagrees with this assessment.

As the case unfolds, it remains to be seen whether Patterson will succeed in overturning her conviction or if she will remain behind bars for the rest of her life.
