Bihar Court Issues Non-Bailable Warrants Against Nine Police Personnel Over Alleged Failure to Appear

A court in Bihar's Muzaffarpur has released non-bailable warrants against nine police officers personnel for their alleged failure to appear as prosecution witnesses in a 2018 case. In which six men were accused of assembling with weapons, allegedly to prepare for a robbery in the district.

Case Concerns 2018 Incident Where

The case concerns a 2018 incident where Saraiya police officers station SHO. Md Allauddin received information at around 9.30 pm that seven to eight criminals. Allegedly armed with weapons, had gathered there to plan a crime.

The prosecution case was that three men riding two motorcycles managed to flee after seeing the police officers. Meanwhile, others allegedly attempted to escape and were apprehended.

According to the material recorded, Loaded country-made pistols and live cartridges were recovered from two other accused. The prosecution case further states that the three men could not provide a satisfactory explanation for the firearms and ammunition or produce documents relating to them.

Court Noted That Summons Had

The court noted that summons had been released to the prosecution witnesses on May 8, 2025. However, they still had not been produced. As a result, the court directed its office to issue non-bailable warrants against them.

The nine police officers personnel named in the order are Sub-Inspectors Md Allauddin, Sattrudhan Sharma and Yogendra Kumar Singh. BMP havildar Sanjay Sharma; constables Abhay Kumar Singh, Azhar Khan, and Rahul Kumar; driver Radhakant Prasad; and investigating officer Anil Kumar.

The court directed the prosecution to produce the witnesses "as per his priority." The case has been listed for prosecution evidence on October 28. The order records that the matter was pending at the stage of prosecution evidence.

The proceedings concern a case filed after a police officers raid at the Bhagat Singh High School field in Manikpur on the night of September 17, 2018. The prosecution case was that seven to eight criminals had gathered there to plan a crime.

The case was filed under Sections 399. 402 and 34 of the Indian Penal Code (IPC) and Sections 25(1-B)A. 26 and 35 of the Arms Act against all six accused.

The court directed that a copy of the order be sent to the Saraiya SHO and the Muzaffarpur SSP for production of the witnesses. The case will proceed with the prosecution evidence on October 28.

The Bihar government has been informed about the non-bailable warrants released against the nine police officers personnel. An inquiry is currently underway into the alleged failure to appear as prosecution witnesses.
