A U.S. District Court Judge has sentenced the CEO of a Georgia-based financial advisory group to 20 years in prison for orchestrating the largest Ponzi scheme in state history.

Todd Burkhalter, the CEO of Drive Planning LLC, was found guilty of defrauding over 2,000 investors out of approximately $380 million. The maximum sentence was imposed after Burkhalter rejected a plea deal and Judge Tiffany Johnson cited his "despicable" conduct as the reason for the harsher punishment.

Burkhalter will also face three years of supervised release and pay $233.7 million in restitution. Two other Drive Planning employees were sentenced to prison terms: Chief Operating Officer David Bradford received a four-year-three-month sentence, while Chief Administrative Officer Julie Edwards received a two-year sentence for her lesser involvement in the scheme.

The Ponzi scheme, which operated from September 2020 to June 2024, targeted investors with promises of guaranteed high returns on investments. However, Burkhalter used investor funds to pay earlier investors, fund his luxurious lifestyle, and pay commissions to marketing agents.

Red flags in the scheme included unrealistic guaranteed high returns on investments and a lack of transparency from Burkhalter and Drive Planning LLC. Experts warn that investors should never invest without doing research and checking for licenses and disciplinary procedures against investment advisers.
